Terms of Service

These Terms of Service (“Terms”) govern the relationship between Zwei Soft Ltd., UIC 208515196, operator of the ZweiHost platform (hereinafter “ZweiHost”, “we”, “us”, “the Platform”), and you (“Customer”, “Tenant”) regarding use of the Website-as-a-Service (WaaS) offering at zweihost.com and related subdomains. The service is intended for merchants and persons acting within their trade, business or profession.

1. Scope

  • a BackOffice admin panel to manage your site’s content;
  • a public website (FrontOffice) rendered from that content;
  • optional modules (shop, booking, blog, AI assistant, etc.) per your plan.

2. Registration

By accepting these Terms you represent that you are 18+ and legally able to enter contracts; that the business information you provide (legal entity, EIK, address, contacts) is accurate and current; and that you will use the Platform lawfully.

3. Payment and subscription

  • Subscription is monthly or annual, in EUR.
  • Prices and included modules are listed in the offer at signup.
  • If payment is over 14 days overdue, ZweiHost may suspend access until paid.
  • Pro-rata refunds apply only if ZweiHost unilaterally terminates without cause.

4. Customer obligations

  • not publish unlawful, misleading, discriminatory, or infringing content;
  • ensure a lawful basis for processing personal data collected via the site;
  • not use the Platform for spam, phishing or other abuse;
  • comply with Bulgarian and EU law, including GDPR.
  • where the Customer's shop offers personalisation with shopper-supplied text or images — include in their own storefront terms a warranty from the shopper that they hold the rights to the material they upload, and review each order before production. ZweiHost does not review or approve shopper-uploaded content.

5. Intellectual property

Platform code, design and infrastructure remain ZweiHost’s property. Content uploaded by the Customer remains their property; ZweiHost receives a limited licence to store, process and display it for the purpose of the service.

6. Processing of personal data (DPA)

Where ZweiHost processes personal data on the Customer's behalf in connection with the Customer's shop/site, the Data Processing Agreement (DPA) forms an integral part of these Terms. In case of conflict on data-processing matters, the DPA prevails over these Terms.

7. Limitation of liability

ZweiHost is not liable for content published by the Customer or its end users; for lost profits or indirect damages; or for temporary downtime due to force majeure or scheduled maintenance (24h notice minimum). ZweiHost's maximum contractual liability is capped at the amount paid by the Customer in the 3 months prior to the event, except for wilful misconduct or gross negligence, breach of confidentiality, infringement of intellectual-property rights, unpaid sums due, indemnities owed by the Customer, or to the extent applicable law, including the GDPR, does not permit limiting liability.

8. Changes and termination

ZweiHost may update these Terms; material changes trigger an email and a re-acceptance prompt. The Customer may terminate with 30 days’ notice; data is kept for 30 days after termination, then deleted.

9. Governing law and jurisdiction

These Terms are governed by Bulgarian law. To the extent permitted by applicable law, disputes between ZweiHost and the Customer are resolved by the competent Bulgarian court at the registered seat of Zwei Soft Ltd. If the Customer qualifies as a consumer under applicable law, this clause does not limit their mandatory rights or the protection of the court having jurisdiction by law.
